Why the accommodation test differs slightly by visa route.

The Home Office doesn’t assess every visa category the same way. A good report should reflect that, rather than treat every application identically.

Take partner, fiancé(e), proposed civil partner, and dependent relative applications under Appendix FM. The sponsor must show the accommodation is adequate. It also can’t become statutorily overcrowded once the applicant moves in. Entry Clearance Officers use the Housing Act 1985’s overcrowding test as the practical benchmark here. So, we build our report directly around that standard.

Visit visa applications work differently. The rules don’t include a formal overcrowding test for these. Even so, a report still helps. It demonstrates genuine ties and suitable accommodation, something Entry Clearance Officers weigh when assessing intent to return home.

Working through the overcrowding calculation

Part X of the Housing Act 1985 sets two tests. A property fails if it breaches either one.

Take the Room Standard first. Two people of the opposite sex, aged 10 or over and not a couple, breach it if they’d have to share a bedroom.

Next comes the Space Standard. It sets a permitted number of occupants from room count and floor area, whichever gives the lower figure. Section 326 of the Act sets this out in two tables.

By room count: a one-room dwelling permits 2 people. Two rooms permit 3. Three rooms permit 5. Four rooms permit 7½. Five or more rooms permit 2 people per room.

Floor area works similarly, measured room by room. A room under 50 square feet (4.65 square meters) counts for nobody at all. One from 50 to under 70 square feet (4.65 to 6.5 square meters) counts for half a person. One from 70 to under 90 square feet (6.5 to 8.37 square meters) counts for one. One from 90 to under 110 square feet (8.37 to 10.22 square meters) counts for one and a half. Anything 110 square feet (10.22 square meters) or more counts for two. We don’t count children under one at all. Children aged one to ten count as half a person each.

It’s a technical calculation. That’s exactly why we work through it carefully, rather than estimate it. Getting it wrong, either way, can cause real problems for an application.

What else the inspection covers

Alongside the occupancy calculation, we assess the property under the Housing Health and Safety Rating System. That’s part of the Housing Act 2004. We check for Category 1 and 2 hazards: damp and mould, poor ventilation, fire safety, structural issues, and general fitness for habitation. We measure every room individually, rather than estimate from a floor plan. Finally, we write the report to the standard Entry Clearance Officers expect under Appendix FM. We deliver it digitally within 24 to 48 hours of the visit.
