Property Inspection Report Cardiff: Does Welsh Housing Law Change Anything?
Wales rewrote much of its housing law in 2016. The Renting Homes (Wales) Act replaced the tenancy system used across England with something called occupation contracts. That’s a genuine legal change. It raises a fair question for anyone applying for a visa with a property in Cardiff. Does any of this affect the overcrowding test your report relies on?
The old system of assured and secure tenancies no longer applies in Wales. Landlords and renters now operate under occupation contracts instead, with different rules on notice periods, written statements, and repair obligations. This is a meaningful shift in how renting works day to day. It’s worth knowing about if you’re renting in Cardiff for reasons entirely separate from your visa application.
Here’s the part that actually matters for your property report. The Renting Homes (Wales) Act’s overcrowding provisions specifically define overcrowding by pointing straight back to Part 10 of the Housing Act 1985, the same legislation that applies in England. Wales didn’t invent a new overcrowding standard. It kept the existing one, and simply referenced it from within the new occupation contract framework. A Cardiff property is assessed against the same Room Standard and Space Standard as one in London.
It would be easy to assume that because Wales has its own housing law now, the whole assessment works differently here. It doesn’t. The parts of housing law that changed relate to how tenancies function day to day. They don’t touch the specific test your visa accommodation evidence needs to satisfy. Your report measures the same things, calculated the same way, regardless of which side of the Severn the property sits.
There is one area where Wales genuinely does things differently, and it’s worth mentioning even though it doesn’t affect the overcrowding test itself. Landlords in Wales must register with Rent Smart Wales, a licensing scheme introduced under the Housing (Wales) Act 2014. England has no direct equivalent covering all private landlords in the same way. This matters more for your landlord’s compliance than for your accommodation report, but if your Cardiff property is rented, it’s a reasonable thing to check alongside everything else.

No. It changed how tenancies work generally, not the overcrowding test itself, which still relies on the same Housing Act 1985 standard used in England.
No. The assessment process, the standards applied, and the report format are identical regardless of which country within the UK your property sits in.
Not for the accommodation adequacy question specifically. What matters is the property itself, not which legal contract framework governs your right to live there.
Yes. The wider South Wales region is within our regular coverage.
Similar to most locations outside London. Getting in touch as soon as your accommodation is confirmed gives the most flexibility for scheduling.
Not directly, since it’s a separate compliance requirement for landlords rather than part of the overcrowding test. It’s still worth checking your landlord is properly registered as good practice.
The legal framework around renting in Wales has changed. The test your accommodation needs to pass hasn’t. Get in touch, and we’ll arrange your Cardiff inspection properly.
